These "Terms and Conditions ("Agreement") is a legal agreement between you ("Customer") and ComputerRepair-USA.com (CRUSA). Your access to the Site (defined here) and remote technical support service providers who are accessible though the Site ("Experts") is governed only by the policies, terms and conditions below. For convenience, we refer to the ComputerRepair-USA.com website and any content therein provided by ComputerRepair-USA as the "Site", we refer to any desktop sharing session or other communications you have via the Internet or telephone related to your ComputerRepair-USA account with the Experts as "Remote Support" and we refer to any technical support services you may receive from an Expert related to your ComputerRepair-USA account or the Site, (including Remote Support) and their listings on the Site as "Expert Services."

This Agreement limits ComputerRepair-USA's liability and obligations to you and allows ComputerRepair-USA to change, suspend or terminate your access to and use of the Site, Remote Support, and Expert Services in its sole discretion. We urge you to carefully read this Agreement and all policies referenced herein or elsewhere on the Site, which are incorporated herein by reference and form part of this Agreement.

YOU UNDERSTAND THAT BY CLICKING THE "AGREE & JOIN" BUTTON, BY USING THE SITE, ANY EXPERT SERVICES, OR BY HAVING ANY FORM OF COMMUNICATION WITH AN EXPERT, YOU ARE AGREEING TO BE BOUND BY THIS AGREEMENT. IF YOU DO NOT ACCEPT THIS AGREEMENT IN ITS ENTIRETY, YOU MAY NOT ACCESS OR USE THE SITE OR EXPERT SERVICES.

GENERAL SERVICES: CRUSA will attempt to diagnosis your computer problem, provide an estimate of applicable service fees and taxes, and then provide you with a solution. There are times, however, when support may not be completed because of a problem with your computer or its configuration that is beyond our control.

Note - computer problems as described by a customer can be completely erroneous - CRUSA bases an initial estimate on the best information available as described by the customer. Often, upon further investigation, more information comes to light which causes CRUSA to revise the initial estimate.

YOUR RESPONSIBILITY: You understand and agree that prior to contacting or allowing CRUSA to perform diagnostic repair or other services on your computer, it is your responsibility to back-up your data, software, information or other files stored on your computer disks and/or drives. You acknowledge and agree that CRUSA shall not be responsible under any circumstance for any loss or corruption of data and/or software.

INSTALLATION AUTHORIZATION: For remote services, a person at least 18 years of age must be present during the entire time period services are provided. If no adult is present, services will be denied.

OUR POLICY TOWARD CHILDREN: CRUSA is not directed to people under the age of 18. We do not knowingly collect personally identifiable information from minors. If a parent or guardian becomes aware that his or her child has provided us with Personal Information without their consent, he or she should contact us via email at Owners@TechProsSD.com. If we become aware that a child under 18 has provided us with Personal Information, we will delete such information from our records.

DESKTOP SHARING SERVICES: An Expert may request that a desktop sharing session (aka, Remote Support) be initiated in order to provide Expert Services to you. To engage in a desktop sharing session you will have to: (i) download and install the CRUSA desktop sharing software application ("CRUSA Software") subject to the terms and conditions of the CRUSA Software License Agreement; and (ii) provide the Expert access to your computer using the CRUSA Software. You must agree to allow access to your computer to enable the Expert to provide you Expert Services. If you do not, the Expert will not be able to provide you with the Expert Service in question.

THE CRUSA SOFTWARE IS NOT SPYWARE, ADWARE OR MALWARE. IF YOU DOWNLOAD, INSTALL OR USE THE CRUSA SOFTWARE YOU ACKNOWLEDGE AND AGREE THAT THE OPERATION OF THE CRUSA SOFTWARE IS WITH YOUR FULL CONSENT AND KNOWLEDGE THEREOF, SOLELY TO PARTAKE OF AND ENJOY THE EXPERT SERVICES REQUESTED BY YOU.

MINIMUM SYSTEM REQUIREMENTS

*At least 10MB free hard disk space and 32 MB RAM on each computer

*Operating system and/or ISP passwords must be available

*Microsoft Windows 98 SE operating system or later

*Operating system discs and key codes must be available

*All computers and/or peripherals must be in good working order and spyware free

ACCESS: The CRUSA representative must have 1) access to your computer(s) and/or peripheral(s) to be serviced, and 2) your consent and cooperation to log-in to your computer. If the CRUSA representative determines that these conditions have not been met, services will be denied and a half-hour minimum fee for labor will be assessed.

The "We Fix It or You Don't Pay" Guarantee means that CRUSA will still charge for labor if the customer opts not to take our advice. If we know the course of action required to resolve the issue in question, yet decides not to take that action, CRUSA is entitled to the labor expended up until that point.

BILLING: CRUSA bills to the nearest 15 min increment and has a 30-min minimum - the clock starts once the customer "accepts" our services and stops when the expert and the customer agree our services are "complete." The relationship between CRUSA and customer is terminated upon payment for remote services and/or software. CRUSA reserves the right to refuse service to anyone for any reason. CRUSA does not enter into any partnership expressed or implied with customer. CRUSA and customer have no outside agreements except what is included here in this agreement.

CRUSA operates on a "time and materials" basis. Payment for services and all software costs are due and payable upon delivery of goods and services. To begin services, CRUSA must have the customers credit card information.

SERVICE LIMITATIONS

LIABILITY:

(a) LIMITATIONS TO SERVICE: CRUSA RESERVES THE RIGHT TO REFRAIN FROM PROVIDING ANY OR ALL REQUESTED SUPPORT SERVICES, WHOLLY OR IN PART, ON THE BASIS THAT YOUR TECHNICAL NEEDS OR OTHER REQUIREMENTS ARE UNUSUAL OR EXTENSIVE AND BEYOND THE SCOPE OF THIS SERVICE AGREEMENT AS REASONABLY DETERMINED BY CRUSA.

(b) FORCE MAJEURE: If CRUSA's ability to render remote services is impaired by you or circumstances beyond the control of CRUSA, CRUSA may choose not to provide or to discontinue remote services.

(c) LIMITATION OF LIABILITY: To the extent permitted by law, you agree that CRUSA's total liability for damages related to its support services is limited to the total amount you pay for the services, and you release CRUSA from liability for any indirect, incidental, special, or consequential damages. To this end, CRUSA strongly advises all of our customers to perform regular and thorough backups. In no event will CRUSA be held liable for any direct or indirect, incidental or consequential damage, loss of use, loss of data, or other malady arising from purchase or use of products or services provided by CRUSA. CRUSA IS NOT LIABLE FOR LOSS, ALTERATION, OR CORRUPTION OF ANY DATA OR FOR YOUR INABILITY TO USE YOUR COMPUTER EQUIPMENT OR OTHER PRODUCT.

SERVICE WARRANTY: If you are not satisfied with support services received from CRUSA, please call 1-800-572-6076 for resolution. We warrant our services for 5 days following the date you received tech support service; however, for repairs necessitated by a virus or spyware, the service warranty is valid only if the anti-virus and anti-spyware protection for your product is installed and properly updated during the repair or promptly thereafter (i.e., before you connect again to the Internet). If there is a problem with the service provided by CRUSA and if you notify us within the warranty period, we will work to remedy your problem quickly and at no additional cost.
